HASSELL-THOMPSON,  HUNTLEY, SAVINO, SMITH --  read  twice  and   ordered

AN ACT to amend the  social services law, in relation to  increasing   the
level of monthly public  assistance grants

THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS  FOLLOWS:

1    Section 1. Paragraph (a)  of subdivision 2  of  section  131-a  of   the
2  social  services  law,  as  amended by chapter 77 of the laws of 1989, is
3   amended to read as follows:
4    (a) (I)  The following schedule shall be the standard of  monthly   need
5  for  determining  eligibility for  all categories of assistance in and by
6  all social  services districts:
7                        Number of Persons in Household
8           One         Two       Three       Four        Five        Six
9        ${112}      ${179}     ${238}      ${307}     ${379}      ${438}
10           140         223         297         383         473        547
11    For each additional person in the household there  shall  be  added  an
12  additional amount  of {sixty} EIGHTY-FIVE dollars monthly.
13     (II)  BEGINNING  ON  APRIL  FIRST,  TWO THOUSAND NINE,  AND EVERY APRIL
14  FIRST THEREAFTER, THE COMMISSIONER OF  THE OFFICE OF TEMPORARY AND  DISA-
15  BILITY   ASSISTANCE SHALL INCREASE THE MONTHLY ASSISTANCE PAYMENTS LISTED
16  IN SUBPARAGRAPH (I) OF THIS PARAGRAPH  BY  A   PERCENTAGE  EQUAL  TO  THE
17  LATEST  FEDERAL CONSUMER PRICE INDEX FOR URBAN CONSUMERS (CPI-U).
18    S  2.  Paragraph  (a)  of subdivision 3  of section 131-a of the social
19  services law, as amended  by section 12 of part B of chapter 436  of  the
20  laws of 1997, is amended to read as follows:
21    (a) (I) Persons and families determined to be eligible by  the applica-
22  tion of the standard of need prescribed by  the provisions of subdivision
23  two OF THIS SECTION less  any available income or resources which are  not

1  required  to  be  disregarded  by other provisions of this chapter, shall
2  receive  maximum monthly grants and allowances  in  all  social   services
3  districts  in accordance with the  following schedule, for public assist-
4   ance:
